Cancel A Timeshare Contract After The Rescission Period

Cancel A Timeshare Contract After The Rescission Period

Have you already passed the rescission period for your timeshare? Still looking for a way to get out of the contract? Well you are not alone. When a consumer completes a timeshare purchase their salesman is supposed to inform them of a small window of time that they can cancel their timeshare contract. This small window of  time is called the rescission period (Sometimes referred to as the grace period). If you are able to send in a cancellation letter to your resort within the rescission period you will receive all of your money back no questions asked. A cancellation letter must be in writing and should include the following info:

  • The name of the timeshare company.
  • The purchasers name as it appears on the contract.
  • The purchasers address, email address, and phone number.
  • The date the timeshare was purchased and the timeshare description.

Rescission periods can range from three days to two weeks, depending on the resort’s policy and the state that you live in. The right to rescind is non-waivable and is put in place so that timeshare owners have a chance to give their decision another thought. Here are few timeshare rescissions laws found in different states:

  • In the state of Alabama the rescission period is 5 days long, not including Sundays.
  • In the state of California the rescission period is seven calendar days long.
  • In Florida the timeshare purchaser can cancel a timeshare contract until midnight of the tenth calendar day of the contract being executed
  • In Nevada the purchaser has until midnight of the 5th calendar day after signing the contract.

The problem is that when you decide to cancel before the cancellation period has expired, resorts can be very hard to get in touch with. Resorts are aware that when new timeshare owners call in after just completing a sale that they are most likely trying to cancel, and they do not answer. Resorts will purposely not answer because they know how difficult it can be cancel a contract after the rescission period has passed. With a simple google search you will find stories from many timeshare owners that have attempted to cancel within the rescission period but the salesman that sold them the property is nowhere to be found. After leaving hundreds of unanswered voicemail some timeshare owners have even flown directly to the resort headquarters  to attempt to cancel in person.

Below is a video of a woman that attempted to cancel a timeshare contract after the rescission period. She states that after returning home from her Wyndham presentation that her salesman and the title office was unable to be reached. To make things worse, this woman was told that she would be able to rent out her timeshare for a profit.
